Terms of Service

I. Definitions Used

1. Store – the online store available at https://courses.leoplaycorner.com through which the Buyer may purchase Products and Services available in the Store.
2. Seller – LAP2J Sp. z o.o., ul. Stefana Żeromskiego 46/7, 91-063 Łódź, Poland, NIP: 7272888345, REGON: 541544161.
3. Online Store Terms and Conditions – these terms and conditions for the provision of services by electronic means, setting out the rules for using the Store.
4. Privacy Policy – a document describing the purposes and methods of data processing, as well as the rights of data subjects.
5. Consumer – a natural person of legal age with full legal capacity, making a purchase from the Seller not directly related to their business or professional activity.
6. Client – a natural person of legal age with legal capacity, a legal entity, or an organizational unit without legal personality but having legal capacity, making a purchase from the Seller directly related to their business or professional activity.
7. Buyer – both the Client and the Consumer.
8. Personal Data Controller – the entity that determines the purposes and means of personal data processing. The Seller is the controller of the Buyers’ personal data.
9. Order – a declaration of intent submitted by the Buyer aimed directly at concluding a contract with the Seller by completing and submitting the electronic purchase form available on the Store’s website, including reading and accepting the Online Store Terms and Conditions.
10. Goods – all physical products available in the Store; the main assortment consists of gadgets supporting education.
11. Product, such as:

• Electronic file, including an e-book – a file containing content intended for reading, available for download after the Seller receives payment. An electronic file is an e-book or another document in electronic form that is not recorded on any tangible medium, in particular in .PDF, .EPUB, or .MOBI format. Each electronic file in the Store includes information about the format in which it is available.
• Online course – access to audio and/or video materials and electronic files delivered on the online platform at https://courses.leoplaycorner.com, which the Buyer receives for the period specified in the selected Subscription or for lifetime access.
• Online consultation – a conversation conducted via electronic communication means (telephone, a dedicated webinar or teleconference tool). The duration and scope of the online consultation are specified in advance before purchase in the Product description in the Store.

12. Statutory warranty (rękojmia) – the procedure for pursuing the Seller’s liability due to a discovered physical defect (non-conformity with the contract) or legal defect of the purchased Product.
13. Guarantee – a voluntary statement regarding the quality of the Goods made by the Guarantor. It specifies the Guarantor’s obligations and the Buyer’s rights if the sold goods do not have the properties stated in the guarantee statement.
14. Guarantor – an entrepreneur who issued the guarantee statement, e.g., the manufacturer, importer, or distributor of the Goods.
15. Account – one of the services provided electronically in the Store by the Seller. The Buyer may voluntarily register in the Store, in particular to continue using Store services, save Products as favorites, or view the history of Orders placed in the Store.
16. Newsletter – one of the services provided electronically in the Store by the Seller, consisting of sending marketing information electronically to the Buyer’s email address, with the Buyer’s prior consent.

II. General Provisions

1. The prices provided by the Seller are expressed in U.S. dollars (USD).
2. The Seller is not a VAT payer.
3. The Seller issues invoices without VAT.
4. The Seller undertakes to deliver Products and Goods free from defects.
5. The Buyer is obliged to use the Products and Goods offered by the Seller in compliance with the laws in force in the territory of the Republic of Poland, in accordance with the provisions of these Terms and Conditions, and not to provide any content prohibited by generally applicable law.
6. Delivery of Files, Online Courses and/or the provision of Online Consultations is carried out via the Internet.
7. All Goods offered by the Seller in the Store are new.
8. The Buyer is required to review the technical requirements necessary to use the Services, specified in the further part of these Terms and Conditions (Technical Requirements).

III. Payment Methods

1. The Seller provides the following payment method:

• Online payment – advance online payment by bank transfer or by Visa, Mastercard, or BLIK card via the external payment system PayU S.A., ul. Grunwaldzka 186, 60-166 Poznań, NIP: 779-23-08-4955, within 5 calendar days from the date of placing the Order.

IV. Conclusion of the Sales Agreement

1. To order a Product via the Store, the Buyer must visit the Store’s website at https://courses.leoplaycorner.com and then select a File, Online Course, Online Consultation, or Goods, following the instructions displayed on the Store’s website.
2. To place an Order, the Buyer must complete the following steps:

• add the Product or Goods to the shopping cart,
• complete the order form by providing details such as the Buyer’s full name or company name,
• provide the email address to which access to the File, Online Course, or Online Consultation will be assigned,
• provide billing details for a receipt or invoice, if the Buyer wishes to receive one, including additional settlement data such as VAT ID number (NIP) and the name of the entity to which the invoice or receipt is to be issued,
• select the payment method,
• accept the Store’s Terms and Conditions,
• confirm the intention to conclude the agreement, including clicking the button “Order with obligation to pay” or an equivalent wording.

3. After the Buyer provides all data necessary to place the Order, an Order summary will be displayed.
4. The Order submitted by the Buyer constitutes a declaration of intent to conclude a sales agreement with the Seller in accordance with these Terms and Conditions.
5. After placing the Order, the Buyer will receive a confirmation message acknowledging receipt of the Order.
6. The sales agreement is deemed concluded at the moment the Buyer makes payment for the ordered File, Online Course, Online Consultation, or Goods.

V. Order Fulfillment

Order fulfillment time depending on the Product category and delivery of Goods.

1. The Seller fulfills Orders for Files and Online Courses within the following timeframes:

• In the case of online payment, access to the purchased File or Online Course is granted automatically after payment authorization. The Buyer receives an email with the File available for download or with registration details for an Account on the Platform. Download of the File and access to the Online Course on the Platform remain inactive until the Seller receives the payment.
• In the case of traditional payment, access to the File or Online Course is granted within 5 calendar days, counted from the day following the day on which the Seller receives the payment.

2. Products available in the Store, in particular Electronic Files, Online Courses, and Online Consultations, are delivered electronically and this does not involve any additional delivery fees in the Store.

VI. Right of Withdrawal

1. The Consumer has the right to withdraw from a distance contract without giving any reason and without incurring costs.
2. Exceptions to the right of withdrawal are specified in the further part of these Terms and Conditions under the section “Exceptions to the Right of Withdrawal.”
3. The period for withdrawal from a distance contract is 14 calendar days from the moment the Consumer takes possession of the Product or Goods.
4. To meet the withdrawal deadline, it is sufficient for the Consumer to send a statement of withdrawal to the Seller before the expiry of the withdrawal period.
5. The statement of withdrawal should be sent to the Seller’s email address: leoplaycorner@gmail.com
6. The Consumer may use Appendix No. 2 to the Act of 30 May 2014 on Consumer Rights.
7. The Consumer may also prepare their own written statement of withdrawal, which should include at least:

• the Consumer’s identification and address details,
• the name or symbol of the returned Goods,
• the date of receipt of the Goods by the Consumer,
• the bank account number or another method for the Seller to refund the cost of the Goods.

8. The Seller shall promptly send the Consumer confirmation of receipt of the withdrawal statement.
9. If the Consumer sends the withdrawal statement by traditional mail, the date of dispatch shall be decisive for meeting the 14-day withdrawal deadline.
10. In the event of withdrawal from the contract, the contract shall be deemed not to have been concluded.

VII. Exceptions to the Right of Withdrawal

1. In the case of ordering a Product, a Consumer who downloads the File, logs into the Platform, or uses the Online Consultation before the expiry of the 14-day withdrawal period loses the right to withdraw from the Order in accordance with Article 38(13) of the Act of 30 May 2014 on Consumer Rights.
2. Pursuant to Article 38 of the Act of 30 May 2014 on Consumer Rights, the Consumer does not have the right to withdraw from a contract:

• for the supply of digital content not supplied on a tangible medium, if the performance has begun with the Consumer’s express consent, after having been informed prior to the commencement of performance that they will lose the right of withdrawal once the performance has been completed by the entrepreneur;
• where the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the withdrawal period expires, provided the Consumer was informed about the loss of the right of withdrawal;
• where the subject of the performance is a non-prefabricated item manufactured according to the Consumer’s specifications or serving to satisfy their individualized needs;
• where the subject of the performance is an item that is liable to deteriorate rapidly or has a short shelf life;
• where the subject of the performance is an item delivered in a sealed package which cannot be returned after opening for health protection or hygiene reasons, if the package was opened after delivery;
• where the subject of the performance consists of items which, after delivery, due to their nature, become inseparably combined with other items;
• where the subject of the performance consists of audio or visual recordings or computer software delivered in sealed packaging, if the packaging was opened after delivery;
• for the supply of newspapers, periodicals, or magazines, with the exception of subscription contracts.

VIII. Refunds and Return of Goods

1. The Seller shall refund the amounts paid by the Consumer within 14 days from receiving the Consumer’s statement of withdrawal, using the same method of payment that the Consumer used, unless the Consumer agrees to a different method of refund.
2. The Seller may withhold the refund of the amounts received from the Consumer until the Goods are returned by the Consumer or the Consumer provides proof of having sent back the Goods.
3. The Consumer should return the Goods without undue delay, and no later than within 14 days from the date of withdrawal from the contract. Returns should be sent to the Seller’s registered office address.
4. The Consumer is liable for any reduction in the value of the Goods resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the Goods.

IX. Refund of Delivery Costs to the Consumer

1. The Consumer does not bear the cost of return, except for the standard costs of returning the Goods to the Seller.
2. The standard return costs borne by the Consumer include, in particular, the cost of packaging for shipment and the postage fee for sending the parcel to the Seller.
3. The Seller shall refund the Consumer the cost of delivery of the Goods to the Consumer, calculated as the cheapest standard method of delivery available in the Seller’s offer.
4. The Seller shall not be obliged to refund the cost of delivery of the Goods to the Consumer in the following cases:

• if the Seller delivered the Goods to the Consumer free of charge, for example after exceeding the minimum order value specified by the Seller or as part of another promotional campaign conducted by the Seller;
• if the Consumer returns only part of the ordered Goods and the delivery costs were calculated for the entire order rather than per individual item.

X. Complaint Procedure under Statutory Warranty

1. The Consumer has the right to submit a complaint under the statutory warranty granted by the Seller within 2 years from the date of delivery of the File, Online Course, or Goods, in the event of a physical defect (non-conformity with the contract) or a legal defect.
2. The Consumer may submit a claim under the statutory warranty to the Seller within one year from the date the defect was discovered.
3. All complaints from Buyers should be submitted in writing or sent to the Seller’s email address.
4. The Seller shall examine the complaint within 14 days from the date of its receipt and shall send a response to the email address or correspondence address indicated by the Consumer.
5. The complaint should include at least:

• the Consumer’s full name, address, and postal code,
• the name of the purchased Product,
• justification of the complaint,
• the date on which the defect in the Product was discovered,
• confirmation of purchase from the Seller (depending on the circumstances, the Consumer may provide one of the following: proof of purchase, order number, payment confirmation, email confirming acceptance of the Order by the Seller, etc.).

6. The Seller shall process the complaint within 14 days from the date of its receipt and send a response to the address indicated by the Consumer (including email address).
7. The Seller shall reimburse the Consumer for the cost of returning the complained-about Goods promptly after a positive resolution of the complaint under the statutory warranty.

XI. Guarantee

1. Goods may be covered by a guarantee granted by the Guarantor.
2. If a given Good is covered by a guarantee, a guarantee document issued by the manufacturer or distributor shall be attached to it.
3. The guarantee period and the scope of the Guarantor’s liability are specified in the guarantee statement and in the description of the Goods or Product.
4. Rights granted under the guarantee are independent of the rights arising from the statutory warranty (rękojmia).

XII. Personal Data Protection

1. The Seller is the controller of the personal data provided during the use of the Store.
2. The rules for data processing and the rights of Buyers under the General Data Protection Regulation (GDPR) are set out in the Privacy Policy available at:

3. The Privacy Policy regulates the principles of data processing related to:

• placing and fulfilling Orders in the Store,
• creating an Account in the Store,
• subscribing to the Seller’s newsletter,
• submitting a review of the Store, Product, or Goods,
• contacting the Seller via the contact form, as well as by telephone or email to the Seller’s direct contact details provided on the Store’s website.

4. The purposes and scope of data processing, the entities to whom the data will be disclosed, and the rights of data subjects are described in the Privacy Policy.

XIII. Technical Requirements

Technical requirements necessary for using the Store and the Products and Services.

1. In order to use the Store and the Products and Services, the Buyer must have:

• a device with Internet access (computer, tablet, or phone);
• a properly configured web browser supporting cookies, such as Internet Explorer, Opera, Mozilla Firefox, Safari, or Google Chrome (recommended: Mozilla Firefox version 24.0 or higher, Opera version 10 or higher, Google Chrome version 28.0 or higher, or MS Internet Explorer version 8.0 or higher), enabling support for cookies and JavaScript. Other browser versions are permitted provided they ensure full compatibility with the versions listed above;
• an active and properly configured email account enabling the Buyer to receive email messages.

2. For security reasons when using the Store and its Products and Services, it is recommended that the Buyer’s device has in particular:

• an up-to-date antivirus system;
• an effective firewall;
• installed and up-to-date security updates for the operating system and web browser;
• enabled acceptance of cookies and JavaScript in the web browser;
• software enabling the reading of files in .PDF format and, depending on the nature of the selected Product, formats such as .EPUB, .MOBI, .docs, .xls.

3. The Client is obliged to use the Products and Services offered by the Seller in accordance with the laws applicable in the territory of the Republic of Poland, the provisions of the Online Store Terms and Conditions, and not to provide any content prohibited by generally applicable law.
4. The Seller shall not be liable for the Buyer’s failure to comply with the above technical requirements necessary for cooperation with the ICT system used by the Buyer. In particular, this applies to situations where the Buyer has improperly configured or failed to configure their email account, resulting in email messages not being delivered from the Buyer to the Seller or from the Seller to the Buyer.

XV. Newsletter

1. The Buyer may subscribe to the Seller’s Newsletter during the Order process or independently of placing an Order.
2. The Newsletter consists of the Seller sending marketing information electronically to the email address provided by the Buyer, with the Buyer’s prior consent.
3. In order to successfully subscribe to the Newsletter, the Buyer must correctly provide the email address to which the information is to be sent and confirm the subscription.
4. Subscription confirmation takes place after signing up. It consists of the Buyer confirming the subscription by logging into the email inbox of the provided email address and clicking the activation link included in the confirmation message.
5. The Buyer may withdraw their consent at any time by using the unsubscribe option available in every marketing message sent by the Seller.
6. The Buyer may also contact the Seller directly to withdraw consent to receive the Newsletter at any time, without affecting the lawfulness of processing carried out prior to the withdrawal of consent.

XVI. Contact Form

1. The Seller enables the Buyer to send inquiries to the Seller via a dedicated contact form available on the Store’s website.
2. The use of the Contact Form by the Buyer is voluntary.
3. In addition to the contact form, the Seller provides a telephone number and email address on the Store’s website through which the Buyer may contact the Seller.
4. The purposes and scope of data processing, the entities to whom the data will be disclosed, and the rights of data subjects are described in the Privacy Policy.

XVII. Copyright and Economic Rights

1. The exclusive rights to the content made available within the Store, in particular copyrights to photographs, names, and trademarks of the Store, including their graphic elements, software, and database rights, are legally protected and belong to the Seller or to third parties with whom the Seller has concluded appropriate agreements. Copying or any other form of use of any elements of the Store without the Seller’s consent is prohibited.
2. The purchase of a File or an Online Course does not transfer to the Buyer any economic or moral copyrights to these Products. The Buyer may use them solely for personal use.
3. In the event of infringement of economic copyrights to photographs, names, trademarks of the Store, including their graphic elements, software, or database rights, the person committing the infringement (including a Client) shall bear liability as provided for under copyright law or intellectual property law.
4. Any identified case of infringement of economic copyrights or other intellectual property rights, for which the Seller is the exclusive owner and entitled party, shall entitle the Seller to impose on the individual infringer a contractual penalty of USD 50,000 (fifty thousand U.S. dollars).
5. In particular, the Buyer is prohibited from:

• removing security features and markings applied to the File or Online Course;
• reproducing the File or Online Course or distributing it, whether in printed or electronic form;
• making the File or Online Course available to third parties, whether in printed or electronic form;
• renting or lending the File or Online Course, whether in printed or electronic form;
• interfering with the content or structure of the File or Online Course.

XVIII. ODR Platform

1. The ODR Platform (Online Dispute Resolution – ODR) is an interactive website for Consumers and Sellers who wish to resolve disputes out of court.
2. The ODR Platform is available at:
   https://ec.europa.eu/consumers/odr
3. Through the ODR Platform, a Consumer residing in the EU, Norway, Iceland, or Liechtenstein may submit a complaint regarding goods or services purchased online from a Seller established in the EU, Norway, Iceland, or Liechtenstein.
4. A complaint is submitted by completing an electronic form and selecting the appropriate entity responsible for resolving the dispute.
5. All institutions listed on the platform have been verified to ensure compliance with applicable regulations and registration by national authorities. In the territory of the Republic of Poland, the competent authority is the Office of Competition and Consumer Protection (UOKiK).

XIX. Final Provisions

1. In matters not regulated by these Online Store Terms and Conditions, the relevant provisions of generally applicable Polish law shall apply, in particular the Civil Code.
2. The court competent to resolve disputes arising from the sales agreement shall be the court having jurisdiction over the defendant’s registered office or the court having jurisdiction over the place of performance for the Consumer.
3. The place of performance shall, in particular, be the designated place to which the Seller is obliged under the agreement to deliver the Product or Goods to the Buyer.
4. The Consumer also has the right to refer a dispute to an entity authorized to conduct out-of-court consumer dispute resolution in accordance with the Act on Out-of-Court Resolution of Consumer Disputes (Journal of Laws 2016, item 1823 of 9 November 2016), without prejudice to the right to bring an action before a court of law.
5. Buyers may access these Online Store Terms and Conditions free of charge at any time on the Store’s website and may print them.
6. These Online Store Terms and Conditions shall enter into force on the date of their publication on the Seller’s website.
7. The Seller reserves the right to amend these Terms and Conditions at any time.
8. Any new or amended Terms and Conditions shall enter into force 14 days after their publication on the Seller’s website.
